These Terms of Service ("Terms") govern your use of the Tagalog Flow mobile application (the "App") provided by Cleverly Interactive ("we", "us", or "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Eligibility
You must be at least 13 years old (or the minimum age required in your country to use the App and any associated app store) to use Tagalog Flow. By using the App, you represent that you meet this requirement and that you are able to form a binding contract.
2. License to use the App
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on a device that you own or control, for your own personal, non-commercial use. This license is also subject to the applicable app store's terms (Apple App Store or Google Play).
3. Things you agree not to do
You agree that you will not:
- Copy, modify, distribute, sell, lease, or create derivative works from the App or its content;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
- Use the App for any unlawful purpose or in violation of any applicable law or regulation;
- Interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or its third-party services;
- Remove, obscure, or alter any proprietary notices; or
- Use automated means to access the App in a way that places an unreasonable load on it.
4. Intellectual property
The App, including its lessons, text, graphics, artwork, logos, design, and software, is owned by Cleverly Interactive or its licensors and is protected by intellectual property laws. Except for the license granted above, these Terms do not transfer any rights to you. "Tagalog Flow" and the Tagalog Flow logo are marks of Cleverly Interactive.
5. Educational content disclaimer
Tagalog Flow is a language-learning aid intended to help you practice Filipino/Tagalog. While we strive for accuracy, language usage varies by region, context, and formality, and we do not guarantee that the content is complete, error-free, or suitable for any specific situation. The App is provided for educational purposes and is not a substitute for professional translation or instruction.
6. Purchases, subscriptions, and renewals
The App is free to start. We may offer optional one-time purchases or auto-renewing subscriptions (for example, an ad-free or premium upgrade). Purchases are processed and managed by the Apple App Store or Google Play and facilitated through our purchase provider, RevenueCat.
- Billing. Payment is charged to your app store account at confirmation of purchase.
- Auto-renewal. Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the period.
- Managing & cancelling. You can manage or cancel a subscription in your app store account settings (Apple App Store or Google Play). Removing the App does not cancel a subscription.
- Refunds. Refunds are handled by the relevant app store in accordance with its policies. We generally cannot issue refunds directly.
- Price changes. We may change prices; changes apply to future billing periods and, where required, will be communicated to you in advance.
7. Advertising
The free version of the App is supported by advertising served through Google AdMob. By using the free version, you acknowledge that ads will be displayed. How advertising data is handled is described in our Privacy Policy.
8. Your data and privacy
Your use of the App is also governed by our Privacy Policy, which explains how information is handled, including by our third-party partners. The App has no user accounts, and your learning progress is stored on your device; uninstalling the App may permanently delete that progress.
9. Third-party services
The App uses third-party services, including Google AdMob, RevenueCat, and the Apple App Store / Google Play. Your use of those services may be subject to their own terms and policies. We are not responsible for the practices of third parties.
10. App updates and availability
We may update, modify, suspend, or discontinue the App or any of its features at any time, with or without notice. We do not guarantee that the App will always be available, uninterrupted, or error-free. Some features may require an internet connection.
11. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEVERLY INTERACTIVE AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE APP IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $10.
13. Indemnification
You agree to indemnify and hold harmless Cleverly Interactive from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or any applicable law.
14. Apple- and Google-specific terms
These Terms are between you and Cleverly Interactive only, not with Apple or Google. The app stores are not responsible for the App or its content. To the extent you obtained the App through the Apple App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You agree to comply with all applicable app store terms of service when using the App.
15. Termination
These Terms remain in effect while you use the App. We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (such as intellectual property, disclaimers, limitation of liability, and indemnification) will survive.
16. Governing law
These Terms are governed by the laws of the jurisdiction in which Cleverly Interactive is established, without regard to its conflict of laws principles, except where mandatory consumer protection laws of your country of residence apply. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
17. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the App after an update means you accept the revised Terms.
